EU Anti-dumping Investigation on Titanium Dioxide to China

On November 13, 2023, the European Commission launched an anti-dumping investigation on behalf of the 27 member states of the European Union against titanium dioxide originating in China (referred to as: EU Anti-dumping Investigation). Under the guidance of China Petroleum and Chemical Industry Federation and with the legal support of Beijing Zhongyin Law Firm, China Coatings Industry Association organized 26 titanium dioxide production companies across the country to complete the submission of relevant materials for responding to the lawsuit before November 20, 2023.

On June 13, 2024, the European Commission announced the disclosure of facts before the preliminary ruling on the anti-dumping investigation of titanium dioxide against China; on July 11, 2024, the European Commission announced the results of the preliminary ruling, calculating the anti-dumping tariff rate based on the dumping margin: Longbai Group 39.7%, Anhui Jinxing Titanium Dioxide Group 14.4%, other responding companies 35%, and other non-responding companies 39.7%.

Regarding the preliminary ruling results announced by the European Commission, China Coatings Industry Association communicated with the law firm immediately and communicated with the China Petroleum and Chemical Industry Federation in a timely manner. With the help of the law firm, we worked with the company to conduct an in-depth analysis of the preliminary ruling results, put forward defense opinions, and reported them to relevant national ministries and commissions. Through the joint efforts of lawyers and companies, a hearing was applied to the European Commission. At the hearing on August 28, 2024, China companies put forward relevant opinions with reasonable evidence.

On November 1, 2024, the European Commission released a disclosure document before the final ruling on the anti-dumping investigation of titanium dioxide against China. The anti-dumping tariff rates were calculated based on the dumping margin: 32.3% for Longbai Group, 11.4% for Anhui Jinxing Titanium Dioxide Group, and 28.4% for other responding companies and 32.3% for other non-responding companies. The tax rate is slightly lower than the preliminary ruling, and no retroactive collection will be carried out.
